Question by : Car sale can i get sued?
Car sale can i get sued?
I sold a 1996 nissan sentra to someone and its been sold for 3 months now. in the emails i exchanged with the person i made it clear the car was in an accident. it was the first car i had and i only had it for a few months. I changed the doors and the car was obviously able to see that it was beat up. he mechanic came to check it and he ok’d it but said i deleted some numbers but i dunno what that is my mechanic said it was in good workin conditions. just looked bad. so it was sold and 3 months later i get a call saying she cant insure it because the registration says it was salvaged? i dont know if the guy before me salvaged it but i was able to insure it fine. the buyer cant insure it and is now threatening to sue me? theyu asked me if the airbags were missing and i dint know because they had never deployed and i had never checked if there in there or not i just assumed they were. can she sue me and win?
I had both registered and insured the car myself. I wasnt trying to conceal anything i explained what was wrong but it can and did run. gave them a test drive and even after he said i deleted numberes ok’d it. He tested the gears and leaks.. Im not to car savy i just knew it ran because i always drove it it just wasnt the best looking.

In my state, California, if a vehicle was salvaged, that appears on the title. If the car was salvaged, the seller would have an obligation to disclose that. I suspect the effort to sue anybody over the value of a 1996 Nissan would not be worth the trouble.

I agree with the above – let her sue you – also my advice – STOP TALKING/TEXTING with her NOW!!!

Did you register the vehicle in your own name? Or did you acquire the car without registering it? If so, you could be in some trouble.
Otherwise, the sale of a used vehicle between private people is considered “as is” unless the seller acted with some type of fraud. If she has a mechanic who will testify he believes you “deleted some numbers” then you could be in some trouble. Additionally, if you failed to register the vehicle in your own name then she could make the argument that you knew the vehicle was salvaged but you were trying to conceal this information.
Her inability to insure a vehicle isn’t as much of a problem as an inability to register the vehicle, though.
